Corey Gaffer Photography Standard Usage Agreement
Any client of Corey Gaffer Photography LLC. Agrees to the following usage rights and copyright information.
Unlimited License
Upon receipt of the final payment, you, the client, will be granted lifetime, unlimited usage rights to all delivered photographs. These lifetime rights include the right to publish, print, and display the photographs in any space you see fit. There are no limitations or restrictions on what may be done with the images other than selling or giving them to others.
Third-Party Purchasing
The initiating client is responsible for dividing costs by selling images to others; Corey Gaffer Photography will issue a single invoice to the initiating client and will not divide the invoice among shoot participants. The initiating client may sell the images to third parties for a period of up to one (1) year from the shoot date, or until the full cost of the shoot has been recouped—whichever occurs first. We recommend a resale rate of $300 per image.
If a split among five (5) or more parties is anticipated, the initiating client must confirm in writing with Corey Gaffer Photography the pricing structure and cost-recovery method prior to any image sales.
Once either (a) one year has elapsed from the shoot date or (b) the total cost of the shoot has been fully recouped through third-party sales, all future usage or licensing requests must be directed to Corey Gaffer Photography at Corey@gafferphotography.com.
Third parties who purchase images are granted the same usage rights as the initiating client, with the explicit restriction that they may not resell, sublicense, or transfer usage rights to any other party.
Unauthorized Image Use
Use of Gaffer Photography images without a valid license is strictly prohibited. Unauthorized usage will incur a retroactive licensing fee of $500 per image.
Copyright
All Photographs shall be the sole and exclusive property of Corey Gaffer Photography LLC., including but not limited to all copyrights and other intellectual property rights in perpetuity. Modification of Photographs and/or incorporation of Photographs in any layout, concept, reproduction, or publication shall not constitute a Joint Work. Photographer shall have the sole power to enforce its copyrights and any other intellectual property, including without limitation all registration, renewal, and reversion rights, as well as the right to register and sue to enforce such rights against infringers. Photographer reserves the right to halt the use of Photographs in any publication that could reasonably be deemed improper, based on the photographer's sole discretion.
Credit Lines
In any and all appropriate uses of the photographs, including client publications and outside publications, the client agrees to credit the photographer as follows. © Corey Gaffer Photography
